Previous Board/Board Committee Actions:
• On October 6, 2009, the Garden's Gate Environmental Impact Report was certified by Resolution No. 09-230 including a Statements of Overriding Considerations and a Mitigation Monitoring & Reporting Program.
• On October 6, 2009, the Vesting Tentative Map (S_3-2005) for the 197-unit Garden's Gate Project was approved by the Board.
• Development Agreement for Garden's Gate Project approved by Ordinance No. 4229 in October 2009 and amended by Ordinance 4264 in July 2010. The Development Agreement vests the project entitlements for the Garden's Gate Project for a period of 15 years (i.e., through August 27, 2025).
• A Final Map for four lots (totaling 1.68 acres) for Tract 261 (also known as Gardens Gate Subdivision Unit One) and a subdivision improvement agreement were approved on October 20, 2020 and deemed consistent with #S_3-2005 (Resolution No. 20-149 and Agreement No. 20-144).
• Rezone #R2-2007 approved in December 2007 by Ordinance No. 4195 and Resolution No. 07-257 and related mapping error on APN 184-110-28 corrected by adoption of Ordinance No. 4504 and Resolution No. 22-085 in April 2022.
• On April 11, 2023, the Mendocino County Board of Supervisors approved the Bella Vista Subdivision Project. Conditions of approval required the establishment of either a Homeowners Association or “other oversight instrument as approved by the County”.
Summary of Request:
The Bella Vista Subdivision Project includes two neighborhoods - the Senior Neighborhood and the Traditional Neighborhood. The Senior Neighborhood will have a Homeowners Association. However, when the Board of Supervisors approved the Bella Vista Subdivision Project in 2023, conditions of approval required the establishment of either a Homeowners Association or “other oversight instrument as approved by the County” for the Traditional Neighborhood. The developer for the project has been in communication with the County requesting that the County establish a Community Facilities District for the traditional neighborhood that would fund the maintenance of the parks (linear and neighborhood) as well as landscaping strips. The Developer has stated that the costs to a homeowner are lessened when a Community Facilities District is established as opposed to a Homeowners Association. The City of Ukiah has expressed interest in taking on the responsibility of the actual maintenance provided the County sets up a Community Facilities District to fund the cost of providing such services.
Staff is seeking direction from the Board today to authorize continued research into the feasibility of establishing a Community Facilities District for the Traditional Neighborhood in the Bella Vista Subdivision as Staff feels that we have expended what is a reasonable amount of time on this subject absent full Board direction to pursue this project further. In order to address some of the County’s questions regarding establishing a Community Facilities District, staff also seeks support from the Board to possibly enter into a contract agreement with a qualified firm for technical support. The Developer has agreed to pay for the costs associated with such a contract, as shown in the letter attached to this agenda item. Continuing to research with the requested technical support will allow County staff to provide the Board with a clear picture of the anticipated workload, benefits and constraints of establishing a Community Facilities District.
After conducting additional research and receiving technical support, County staff would bring an agenda item back to the Board for formal action and direction to proceed with establishing a Community Facilities District for the Traditional Neighborhood in the Bella Vista Subdivision.
Alternative Action/Motion:
Direct staff to stop any additional research into the feasibility of establishing a Community Facilities District and require the developer to create a Homeowners Association.
