Previous Board/Board Committee Actions:
On May 17, 2019, the Board approved Revenue Agreement 19-133 with the State of California, Department of State Hospitals (DSH) to establish a Small County Model JBCT Program at the Mendocino County Jail. On July 14, 2021, the Board approved Revenue Agreement 21-146 with the DSH for the administration of a 4-6 bed JBCT Program at the Mendocino County Jail that was effective through June 30, 2024.
Summary of Request:
The State of California, Department of State Hospitals (DSH) funds county correctional facilities to provide Jail-Based Competency Treatment (JBCT) Programs. The JBCT Program is designed to reduce the time it takes, or may even eliminate the need for the DSH to perform the process of evaluating mentally ill inmates who are ordered to undergo competency treatment by the courts. Having this program at the Mendocino County Jail ensures that the process is streamlined, fiscally prudent for the State and the County, and the court process is timelier and more efficient. The Sheriff’s Office administers delivery of the JBCT Program of which services include, but are not limited to: providing restoration of competency treatment services for patient inmates who are found by the courts to be incompetent to stand trial; providing board, care, routine and non-routine medical care for patient inmates referred and admitted to the JBCT Program; and providing any administrative services required under the Agreement.
The DSH will reimburse the Sheriff’s Office for two allocated patient inmate beds at the per diem rate of $376 per bed, totaling $752 per day and two non-allocated patient inmate beds at the same rate. Reimbursement by the DSH also includes the cost of any administered medications. This Revenue Agreement is for one year and will not exceed $614,384.13.
The Sheriff’s Office received the final Revenue Agreement from the State of California in August of 2024, which was then routed through the County’s review and approval process. This contributed to the Revenue Agreement being retroactive.
