Approve retroactive amendment to BOS Agreement 22-155 (third Amendment to Agreement No. PH-21-013, PA 22-01) with David Jensen DBA DJ Consulting, in the amount of $50,000 for a new total of $150,000, for consultant services that are critically needed to facilitate Environmental Health performance and compliance with applicable regulations, effective October, 8, 2021, through a new end date of June 30, 2024 (original end date: June 30, 2023); authorize the Chief Executive Officer or designee to sign any future amendments to the Agreement that do not increase the annual maximum amount; and authorize Chair to sign same.

Summary of Request:
Former Environmental Health Director, Trey Strickland and former Public Health Director Anne Molgaard, previously reached out to Environmental Health professionals, including retired and interim professionals who work contractually throughout the State, who are familiar with the North Coast and the structure of county government, and are Registered Environmental Health Specialists (REHS). The goal of this outreach was to find someone to provide services related to Mendocino County Environmental Health performance and compliance with applicable Federal, State and local regulations. As a result of outreach, only one candidate was found willing to provide these services to Environmental Health: David Jensen (DBA DJ Consulting).
In addition to outreach efforts, a revised job description for an Environmental Health Director was approved by the Civil Service Commission, and the position opened for active recruitment for a couple of weeks in December 2022. In an attempt to fill this position, Environmental Health managers have participated in the California Conference of Directors of Environmental Health (CCEDH) and the related California Association of Environmental Health Administrators (CAEHA) for additional resources and potential Environmental Health Director services. Through these efforts, it has become apparent that many jurisdictions are searching for Environmental Health Director services due to a large number of registered persons retiring at a rate that is outpacing the availability of qualified individuals.
On October 8, 2021, the Mendocino County Purchasing Agent (PA) approved Agreement No. PH-21-013, PA 22-01, through which DJ Consulting provides consulting services to Mendocino County Environmental Health, including assistance with the recruitment and training of a permanent Environmental Health Director. On January 20, 2022, the PA approved first Amendment No. PH-21-013-A1, PA 22-01-A1, extending the Agreement termination date from December 31,2021 to June 30,2022. On June 21, 2022, the Mendocino County Board of Supervisors approved second Amendment No. BOS-22-155, extending the Agreement termination date from June 30, 2022 to June 30, 2023, and increasing the total Agreement amount from $50,000 to $100,000.
Due to the ongoing need for services through Agreement No. PH-21-013, PA 22-01, this proposed third Amendment extends the termination date from June 30, 2023 to June 30, 3024, and increases the total amount for a new total of $150,000, for the continuation of these critically needed services to facilitate Environmental Health performance and compliance with applicable regulations.
This amendment is retroactive due to changes to staff duties between Public Health and Environmental Health and prolonged revisions.
