Adopt the Resolution approving and executing Department of Transportation Agreement Number 240013 - Memorandum of Agreement between the Manchester Band of Pomo Indians and the County of Mendocino for vacation of county roadway right-of-way on Mamie Laiwa Drive (County Road 508A) and Rancheria Road (County Road 510A) (Point Arena Area), and waive the County Road vacation fee; and authorize Chair to sign same.

Previous Board/Board Committee Actions:

By Resolution 66-216, approved on October 11, 1966, the Board accepted Rancheria Road (County Road (CR) 510A) right-of-way for public use. On October 26, 1956, the Road Commissioner accepted the “Rights of Way” for Mamie Laiwa Drive.

Summary of Request:

Pursuant to correspondence to the Mendocino County Department of Transportation (MCDoT) by Tisha Gonzalez neé Jones, Tribal Chairwoman of the Manchester Band of Pomo Indians, concerning County Maintained Roads Mamie Laiwa Drive (CR 508A) and Rancheria Road (CR 510A), a Memorandum of Agreement (MOA) toward road vacation has been prepared. This MOA establishes the roles and understanding between the County and the Tribe. The Manchester Tribe, as a government, has requested that Board of Supervisors (BOS) process whatever is necessary to get these roads back to the Tribe while waving the normal $2,423 application fee and title research of properties served by the roads in question. This is expected to be a summary vacation since the roads are entirely contained within property under one ownership and do not continue through properties of another (Streets & Highways Code 8334).

Alternative Action/Motion:

Not execute the agreement and provide direction to staff.
