Summary of Request

The Lanterman-Petris-Short Act is the California law governing the involuntary civil commitment of individuals who, due to mental illness, pose a danger to themselves, a danger to others, or who are gravely disabled and require inpatient psychiatric care. The intent of the LPS Act was to end inappropriate lifetime commitment of people with mental illness and firmly establish their right to due process while significantly reducing state institutional expense.

 

Pursuant to the requirements of the LPS Act, Mendocino County is responsible for providing residential care services to LPS clients who are court-mandated to receive a specific level of care requiring a structured environment due to mental health challenges. Currently, there are not local facilities in Mendocino County that are able to provide all levels of care as mandated by the courts. In addition, there is a shortage of residential care facilities statewide, which creates competition for these placements. As a result, Behavioral Health and Recovery Services (BHRS) contracts with multiple residential care facilities in order to help manager the shortage, and to maintain current client placements ensuring the most appropriate care within the largest possible placement options.

 

Generation Health Care of Auburn DBA Siena Skilled Nursing and Rehabilitation is one of the residential care facilities providing care to Mendocino County Clients. Generation Care located in Auburn California is a skilled Nursing Facility providing a broad range of services for adult clients including psychological rehabilitation support, activities and educational opportunities to improve life skills, treatment by a psychiatrist, and provision of health care needs.

 

A retroactive amendment is being requested, as the placement was utilized at a higher rate than was anticipated during this fiscal year. This placement has been able to accommodate clients with more complex presentations than some of our other levels of care requiring an increased utilization and increased in cost of care for clients of Mendocino County in the final months of the contract.
