Summary of Request: 

Under the Government Claims Act (Government Code Section 900 et seq.), a claim relating to a cause of action for injury to a person or to personal property must be presented to the County no later than six months after the accrual of the cause of action.

 

Pursuant to California Government Code § 911.4, an application to present a late claim must be presented within one year of the accrual of the cause of action. Moreover, a claimant applying to present a late claim must establish that the failure to timely present the claim was attributable to one of the factors listed in Government Code § 911.6.

 

On August 20, 2026, Claimant presented a claim to the County, related to an incident alleged to have occurred on February 2, 2026. The Claim was returned as untimely. On September 16, 2026, Claimant submitted an application to present a late claim against the County. However, the application fails to show that the failure to submit a timely claim in this case was attributable to any of the listed factors.

 

County Counsel recommends denial of the request
