Previous Board/Board Committee Actions:

On December 17, 1951, Ordinance No. 328 was adopted to establish the County Public Department of Public Health, and subsequent amendments through the adoption of the following Ordinances: Ordinance No. 342, adopted September 15, 1953; Ordinance No. 1415, adopted January 28, 1975; and Ordinance No. 4152, adopted November 8, 2005. On February 11, 2025, the Board of Supervisors introduced and waived the first reading of the ordinance.                     

 

Summary of Request

Chapter 2.44 of the Mendocino County Code establishes a local Department of Public Health.  It is intended to meet requirements for state and federal financial assistance for local public health departments. 

 

The majority of the provisions in Chapter 2.44 have not been updated since 1951.  Among other things, the chapter refers to statutes that have since been repealed or changed, and to titles of positions that have since been changed (for example, the term “sanitarian” in Chapter 2.44 is now “registered environmental health specialist” under state law.)

 

The last substantive amendment to Chapter 2.44 was in 2005, when section 2.44.025 of the Mendocino County Code was adopted to provide for a Public Health Director. 

 

On June 4, 2024, the Board of Supervisors adopted Resolution 24-092, which amended the County’s position allocation table.  Resolution 24-092 added the position of Director of Health Services and deleted the positions of Director of Public Health and Director of Behavioral Health.

 

The proposed amendments to the County Code are intended to do the following:

 

(1)  Amend the County Code to conform to the Board’s action in Resolution 24-092. The proposed code amendment establishes the position of Director of Health Services, tasked with performing the roles of both the Director of Public Health and the Director of Behavioral Health & Recovery Services. While the departments remain separate, the code amendment allows for the consolidation of administrative functions.  The Board may take such action by ordinance as authorized by Government Code sections 24308 and 33200.

 

(2) Make additional revisions designed to bring Chapter 2.44 in line with current law and practices.

 

The proposed amendments are requested to be operative retroactive to June 4, 2024, coinciding with Resolution 24-092.
