Previous Board/Board Committee Actions:

The Board of Supervisors adopted a Franchise Agreement with Adelphia Communications on April 19, 2005.  The Board of Supervisors approved a Franchise Transfer Agreement from Adelphia to Comcast in December 2005. A Memorandum of Understanding was executed between the City of Ukiah and the County pertaining to the disbursement of one-time PEG related capital grant funding for infrastructure, as well as designating the County as the PEG provider for the County including incorporated areas of the City of Ukiah. The County initiated a Request for Proposal (RFP) in 2007/2008 for the provision of PEG services within the County of Mendocino.  As a result of this RFP, agreements were executed with PEG providers since 2007 (in the cities of Willits, Fort Bragg, and Ukiah).  On December 16, 2016, the Board of Supervisor’s received an update regarding the status of the various PEG programming and service providers, assigning the matter of allocation and programming of Public, Educational and Governmental (PEG) Access Television fees and services in Mendocino County to a Board of Supervisors Ad Hoc Committee consisting of Supervisors Gjerde and McCowen.

 

Summary of Request

 

Historically, a portion of franchise fee income, currently 50%, has been directed to the General Fund with the remainder allocated based on the amount of franchise fee revenue generated in the Ukiah, Willits and Fort Bragg areas. It is recommended that a small amount of funding be reserved for possible assistance to facilitate recording and broadcasting of public meetings on the south coast and that the remainder of the 50% dedicated to PEG programming be divided equally among community partners in the Ukiah, Willits and Fort Bragg areas. It is recommended that the County contract with our existing community partners in Willits and Fort Bragg and that funds be disbursed within the first half of the fiscal year. It is recommended that funds set aside for the south coast and Ukiah be held by the County until such time as community partners in those areas are identified and contracted with.

 

In summary, it is recommended that 50% of the County’s share of franchise fee income be directed into the General Fund; $5,000 be reserved for possible use by a south coast community partner; the remainder of the 50% dedicated to PEG programming be divided equally between community partners in the Ukiah, Willits and Fort Bragg areas; that the County contract with existing community partners in the Willits and Fort Bragg areas with funds to be disbursed within the first half of the fiscal year; that funds allocated for the Ukiah area be held by the County until a community partner is identified.

 

It is further recommended that the ad hoc committee continue to work with staff to develop recommendations to the Board regarding contract conditions related to PEG programming and performance requirements, including an obligation to record and broadcast specified public meetings.
