Adopt Resolution of the Mendocino County Board of Supervisors declaring intent to establish speed limits of 20 miles per hour at selected school zones between now and January 1, 2031, when all school zones will be 20 miles per hour pursuant to Assembly Bill 382 (Countywide); and authorize Chair to sign same.

Summary of Request

Assembly Bill (AB) 382 will decrease school zone speed limits to 20 miles per hour (mph) on January 1, 2031.  The change will be state-mandated; every school zone speed limit will default to 20 mph wherever proper signage is posted, no local action required.

 

Local agencies do not have to wait until 2031 to establish 20 mph speed limits in school zones. AB 382 adds a temporary provision through January 1, 2031, authorizing a city or county, by ordinance or resolution, to adopt a 20 mph speed limit in a school zone, using the same 500-foot school zone definition that will apply statewide in 2031 (Vehicle Code, § 22352.5(a), (b)).

 

The Mendocino County Department of Transportation (DOT) requests the Board of Supervisors adopt a resolution which directs DOT, upon determination by the Road Commissioner by a meritorious request or maintenance efficiency, to erect, place, and maintain the appropriate traffic marking and control devices necessary to indicate and establish said 20 mph school speed zone changes by January 1, 2031.

 

Alternative Action/Motion:

Do not authorize the Road Commissioner, by a meritorious request or maintenance efficiency, to erect, place, and maintain the appropriate traffic marking and control devices necessary to indicate and establish AB 382 20 mph school speed zone changes by January 1, 2031.
