Previous Board/Board Committee Actions:

At the June 25, 2024, meeting, the Board approved the Fiscal Year 2024-25 budget, including approval and appropriation for the Juvenile Hall Backup Generator Project in the amount of $369,223 and the Juvenile Hall Fencing project in the amount of $40,000. At the December 17, 2024 meeting, the Board approved the design and engineering agreement for the project with Yao Engineering in the amount of $56,825.                     

 

Summary of Request

The majority of the Mendocino County Juvenile Hall facility currently lacks backup power, creating operational and safety concerns during utility outages. The Juvenile Hall Backup Generator and Fencing Project will provide for the installation of a new emergency backup generator system to supply power to the facility’s main electrical service panel to support the continued operation of critical building systems during power interruptions and provide long needed improvements to the perimeter fencing for the facility.

 

On May 23, 2026, three bids were received for the Juvenile Hall Backup Generator and Fencing project with Ferranti Construction’s bid being by far the lowest bid. While the second low bidder submitted a protest letter citing a subcontractor listing error, staff, including the County Counsel’s office, found that the bid irregularity met the intent of the legislation and did not offer the bidder an advantage. The protesting bidder has elected not to appeal staff’s determination.

 

Several factors were found to have increased project costs since the project was created in 2024. Cost escalation for major manufactured products like generators over the two years since then have continued to rise; additional security measures were requested in developing the fencing scope including an automatic gate operator and security camera modifications; and numerous underground utilities were found to be present at the generator location, requiring specialized excavation.

 

With the likelihood that delays needed to re-bid the project could further increase the cost, staff recommends approval of the appropriation and award.

Do not authorize the award and provide direction to staff.
