Summary of Request

Under the Government Claims Act (Government Code Section 900 et seq.), a claim relating to a cause of  action for injury to a person or to personal property must be presented to the County no later than six months after the accrual of the cause of action.  On May 22, 2026, Claimant in this matter presented a claim regarding injuries allegedly suffered between 2001 and January 26, 2026; however, the claim failed to state the specific dates, places or other circumstances of the occurrences, events, or transactions which allegedly gave rise to the claim.

 

The claim was therefore returned as untimely as to all injuries that allegedly occurred prior to November 22, 2025. On June 10, 2026, Claimant submitted a letter applying to the Board for leave to present a late claim. Pursuant to California Government Code § 911.4, an application to present a late claim must be presented within one year of the accrual of the cause of action. Moreover, a claimant applying to present a late claim must establish that the failure to timely present the claim was attributable to one of the factors listed in Government Code § 911.6.  The application fails to show that the failure to submit a timely claim in this case was attributable to any of the listed factors.

 

County Counsel recommends rejection of the request.
