Summary of Request:
On September 22, 2024, Governor Newsom signed Assembly Bill (AB) 2561 into law to amend the Meyers-Milias-Brown Act adding Section 3502.3 to the Government Code.
Effective January 1, 2025, Assembly Bill (AB) 2561 declares that job vacancies in local government are a widespread and significant problem for the public sector, and that job vacancies may undermine labor relations between public agencies and employees. AB 2561 requires that, on an annual basis, public agencies assess and address vacancy rates to help avoid the negative effects of understaffing on the delivery of public services and public employees.
As outlined in Section 3502.3, the presentation must be made prior to the adoption of a final budget for the fiscal year. This report must also address the current recruitment and retention efforts and identify any changes to policies, procedures or recruitment activities that negatively impact efforts to reduce vacancies.
Upon request of a recognized employee organization, additional information may apply if the number of vacancies exceeds twenty percent (20%) of the total number of allocated full-time positions in a particular bargaining unit.
The intent of the new law is to require public reporting on information regarding vacancy rates to leverage the disclosure of such information to increase staffing at public agencies.
The County has already taken steps to reduce vacancy rates that include a clean up of the Position Allocation Table (PAT) to delete positions that departments are no longer utilizing and do not intend to fill. Departments are actively reviewing their staffing to determine what classifications they need for an effective organization, especially for recruitments that are hard to fill.
