Previous Board/Board Committee Actions:
During the October 31, 2023 meeting of the Board of Supervisors the Board adopted a resolution assuring necessary matching funds and conditionally approving contract award to Broward Builders, incorporated, in the amount of $35,859,000 for the construction of the SB844 jail building serving as a behavioral health wing, authorizing contract execution upon funding approval by the State Depart of Finance and directed the Chief Executive Officer to bring an item outlining detailed plan to fund the jail up to 7 million dollars that will be borrowed against Measure B, including interest and a repayment plan once the jail has been completed; and authorized the Chief Executive Officer or designee to act as Project Manager and enter contracts and approve change orders for the project, pursuant to Public Contract Code Section 20142. On April 9, 2023, the Board of Supervisors, received information and proposed terms from the Acting Auditor-Controller/Treasurer-Tax Collector regarding utilization of $7,000,000 of Measure B Funds and directed staff to bring back a resolution regarding the same and outlining the Board’s commitment to replenish the Measure B funds with interest such that those funds may later be used other permissible uses allowable under Measure B.
Summary of Request:
Based on the Board’s direction at the April 9, 2023, meeting, the Executive Office and Acting Auditor-Controller/Treasurer-Tax Collector (ACTTC) bring back the attached resolution providing for the utilization of seven million dollars ($7,000,000) of Measure B funds for construction of the Behavioral Health Wing of the Mendocino County Jail and outlining the Board’s commitment to replenish the same with interest such that those funds may later be used other permissible uses allowable under Measure B. For some context, the Behavioral Health Wing is being constructed, in part, to provide additional behavioral health and mental health services as well as addiction treatment programs to incarcerated individual. Measure B provides funding to provide for the necessary infrastructure to support and stabilize individuals with behavioral health conditions, including addiction and neurological disorders and provides that, for a period of five (5) years, a maximum of 75% of the revenue deposited into the Mental Health Treatment Fund may be used for facilities, with not less than 25% dedicated to services and treatment. The Measure B Fund currently has a surplus which is included in the County Treasury pool and as reported by the Acting ACTTC at the April 9 meeting, currently receives interest at the of two percent (2%) per year which is based on the pooled interest rate for Quarter 2 Fiscal Year 2023/24. This resolution outlines the intent of the Board of Supervisors to replenish the utilized funds in accordance with the terms in Exhibit A (on or before September 15, 2034) including interest of two and one-half percent (2.5%), more than the Measure B Fund is receiving from the County Treasury pool. As further indicated by the Board during the April 9 meeting (and outlined in this Resolution), the County’s Pension Obligation Bond expense will terminate on June 30, 2027, which could provide an opportunity as of FY 2027-2028 to replenish the Measure B Fund and permit replenishment of the Measure B Funds by FY 2028-2029. The attached replenishment schedule anticipates that first replenishment transfer will occur by September 15 of each fiscal year commencing with Fiscal Year 2025-2026.
