Adopt resolution approving an emergency Agreement with Garland DBS Inc., in the amount of $399,864, for the Capital Improvement (CI) Project to replace the Agriculture & Farm Advisor Building roof, at 890 North Bush Street in Ukiah CA, for the period of one hundred fifty calendar days from the effective date of the contract; authorize the Purchasing Agent or designee to sign and execute the Agreement, change orders, and other documents related to the Project; and authorize Chair to sign the same.

Previous Board/Board Committee Actions:

At the March 14, 2023, meeting, the Board of Supervisors approved creation of the CI project and funding for the Agriculture & Farm Advisor Building Roof Replacement Project in the amount of $300,000 from the Certificate of Participation bond funding.

 

Summary of Request

During the 2022-23 winter storm emergencies, the Agriculture Building experienced significant roof leaks prompting staff to request funding to expedite the roof replacement prior to the next winter season. The Board approved the project and $300,00 of the requested funding at the March 14, 2023, meeting. It has been determined to be in the best interest of the County to award this contract on an emergency basis in order to expedite the replacement of the roof for the Agriculture & Farm Advisor building before we enter into another storm season. Pursuant to Public Contract Code Section 22050(a)(1), in the case of an emergency, the Board of Supervisors, pursuant to a four-fifths vote, may repair or replace a public facility, take any directly related and immediate action required by that emergency, and procure the necessary equipment, services, and supplies for these purposes, without giving notice for bids to let contracts. Public Contract Code Section 1102 defines an emergency as “a sudden, unexpected occurrence that poses a clear and imminent danger, requiring immediate action to prevent or mitigate the loss or impairment of life, health, property, or essential public services”.

 

Staff requested a design and installation proposal from Garland DBS.  This proposal and contract award provides for the replacement of the roof and gutters, necessary dry rot repair and related work to the Agriculture and Farm Advisor Building. Primary funding for this project is from the Certificate of Participation Bond funding of $300,000, with the balance of the project costs ($99,864) from the unanticipated roof replacement allocation of the Capital Improvement/Capital Maintenance Reserve fund.

Do not authorize award and provide direction to staff.
