Summary of Request:
The Board has publicly discussed reducing the amount of real estate owned by the County. A first step in this process, governed by the Surplus Land Act (SLA), as amended, will be taken with the Board’s adoption of these resolutions, declaring excess parcels as either “surplus” or “exempt surplus” and providing direction to staff. Under the SLA, surplus land is prioritized for affordable housing as well as parks and open space. Exempt surplus land is exempt from procedural requirements under the SLA due to it meeting criteria under Government Code section 54221(f)(1). Additional Board action would be needed to authorize staff to begin negotiations for the potential sale of these parcels, and to approve any sales agreements. A staff report is attached. It is recommended that the Board adopt five separate resolutions, designating the Covelo Community Services District Office, the Boonville Veterans Memorial Building, the land upon which the Anchor Bay Firehouse was built, and a vacant parcel south of Willits as “exempt surplus” land, and the vacant County office building at 120 W. Fir St in Fort Bragg as “surplus” land.
These resolutions have been reviewed with respect to the applicability of the California Environmental Quality Act (Public Resources Code Section 21000 et seq.) (“CEQA”) and it has been determined that the designation of these properties as surplus does not have the potential for creating a significant effect on the environment and therefore exempt from further review under CEQA pursuant to State CEQA Guidelines Section 15060(c)(3) because they are not projects as defined by CEQA Guidelines Section 15378. Adoption of these resolutions does not have the potential for resulting in either a direct physical change in the environment or a reasonably foreseeable indirect physical change in the environment. If and when a Property is sold to a purchaser, and that purchaser proposes a use for the Property, and such use requires a discretionary permit and CEQA review, that future use and project will be analyzed at the appropriate time in accordance with CEQA.
