Approve Agreement (first amendment to Agreement PA -25-27) with Farrington Law to increase the amount by 23,000 for a new total of 65,600, to provide certification review hearings for individuals under WIC 5150 to Mendocino County Behavioral Health and Recovery Services beneficiaries, effective May 1, 2024, through June 30, 2025; authorize the Health Services Director or designee to sign any future amendments to the Agreement that do not increase the annual maximum amount; and authorize Chair to sign same.

Summary of Request:
AB2275 revised the processes for Welfare and Institutions Code 5150 holds. This revision requires the County to obtain and provide a Hearing Officer for “Certification Review Hearings” for Mendocino County clients who are held under WIC 5150 but have not been certified under section 5250. If these individuals still meet the criteria for a continued involuntary hold under section 5150 after seventy-two (72) hours, a hearing must take place. Anthony Farrington is currently the only trained hearing officer in the area who can provide this mandated service for Mendocino County.
As a result of this amendment, Behavioral Health and Recovery Services will continue to receive state-mandated “Certification Review Hearings” from Farrington Law, covering the period from May 1, 2024, to June 30, 2025.
The contract amount estimated at the beginning of the contract was insufficient to cover costs until the end of the fiscal year 24-25. Therefore, Behavioral Health and Recovery Services (BHRS) has increased the contract amount to $65,600 with Farrington Law to ensure the provision of these state-required “Certification Review Hearings” services.
