Previous Board/Board Committee Actions:

By Minute Order (July 7, 2015), the Board approved Board of Supervisors (BOS) Agreement Number (No.) 15-071 with Cold Creek Compost, Inc., for composting services.  By Minute Order (March 19, 2019), the Board approved Amendment No. One to BOS Agreement No. 15-071.                     

 

Summary of Request

Department of Transportation (DOT) Agreement No. 220036 is an Amended and Restated Agreement between the County and Cold Creek Compost, Inc. (Cold Creek), for organic waste composting services.  This agreement incorporates new requirements of Senate Bill (SB) 1383, including more stringent organic waste handling and processing standards, and record-keeping and reporting requirements.  Additionally, the Agreement guarantees capacity to the County of 4,000 tons per year, as required by SB 1383, and provides for an annual donation of 150 tons of compost by Cold Creek to the County to help the County in meeting its new recycled organic waste product procurement requirements.  The Agreement is not exclusive and still allows the County to contract with other facilities for organic waste processing as desired or needed.  The current Agreement with Cold Creek is set to expire on December 31, 2022.  This Amended and Restated Agreement will extend the expiration date to December 31, 2037, and increase the current tipping fee from $38.58 per ton to $60.00 per ton beginning January 1, 2023. The increased tipping fee will be passed through to solid waste customers through curbside collection rates and transfer station gate fees; however the increase will be nominal, likely only 0.5-2%.  At $60.00, the tipping fee will still be well below the regional average rate for organic waste processing, with most other composting facilities in Northern California charging in the range of $70-100 per ton.  The Agreement also keeps the County’s organic waste local, supporting a locally-owned business, contributing to sales tax revenue, and avoiding increased greenhouse gases and transportation costs associated with transporting to an out-of-county facility.  DOT staff respectfully recommends and requests the Board adopt the resolution approving DOT Agreement No. 220036, Amended and Restated Agreement Between the County of Mendocino and Cold Creek Compost, Inc., for Organic Waste Composting Services.
