Provide policy consideration that the defined benefit of improved emergency escape on existing public roads by providing private roads for the purpose of alternate dry weather access for emergency equipment alternate route(s) to reduce the need for two way traffic on public roads and provide the benefit for evacuation traffic, such assessment for maintenance cost  of that benefit should be borne by improved parcels with residential or business associated occupancy,  direct County staff to continue work on necessary steps to implement the County Service Area 3 Sherwood Firewise Communities Zone Of Benefit Pilot Program, approve and authorize expenditure of designated funds in Land Improvement Budget Unit 1910 be transferred to County Service Area 3 for contracting up to $45,000 for preparation of zone of benefit boundary maps and descriptions as official filing document records and acknowledge that Land Improvement Budget Unit 1910 has available funds to cover such costs (Sherwood Road Area).

Previous Board/Board Committee Actions:

The Board of Supervisors (BOS) appointed the ad hoc committee for one-way-in, one-way-out communities.  The Board of Supervisors has approved the continuation of County Service Area 3 (CSA 3) and budgeted for its continuance.  On January 25, 2021, the Board received a presentation on a plan to implement the CSA 3 Benefit Zone Pilot Program for the Sherwood Firewise Communities (SFC) area and designate the Transportation Department - Land Improvement Division and authorize expenditure of County General funds in available budget units for contracting up to $15,000.  On August 3, 2021 the BOS received an update on SFC Pilot Program progress and acknowledged Land Improvement Budget Unit (BU) 1910 had expended $20,000 in staff effort to date and anticipated additional effort required in completing this process to be a total estimated cost of $60,000.                     

 

Summary of Request

Direction is requested from the BOS to direct staff to continue this process, determine the appropriate POLICY to establish a Zone of Benefit (ZoB) for "Willits Creek and Firco Emergency Equipment Access Routes" Serving Sherwood Firewise Communities for benefit of improved emergency escape on existing public roads by providing emergency equipment and assessment for payment for that benefit to improved lots with residential or business improvements and associated occupancy.

 

Next steps will require staff time and additional resources to have an engineering report done and to conduct an election in order to set up the ZoB:

1.                     Land Improvement Budget Unit 1910 has expended as of August 3, 2021, $20,000 in staff effort to date and anticipates that an additional $20,000 to $40,000 in staff effort will be required to complete this effort for a total estimated cost of $60,000.  Furthermore, Local Agency Formation Commission (LAFCo) may require filing of ZoB Map/Description documents costing up to $45,000 for consultant procurement under Purchasing Agent Authority ($50k limit) and Exception to Bid pursuant to Policy #1.

2.                     Timeline to complete this effort so an approved assessment can be included on the Fiscal Year (FY) 22-23 tax bill is anticipated to include a Board of Supervisors agenda item - Notice of Intent to Form a CSA 3 Zone of Benefit on March 15, 2022.  A second Board of Supervisors agenda item to conclude the ballot process and certify the results on May 17, 2022.

3.                     Direction from the Board to establish a perimeter boundary for the ZoB (Brooktrails Fire District boundary plus the Gates Subdivision boundary), see attached Benefit Zone Map August 3, 2021, exhibit and meet the exception of LAFCo for the proper filing of the ZoB Boundary under CSA 3 and direct staff to bring back to the BOS such application for latent power to LAFCo for Transportation/Circulation Enhancements as described herein.

4.                     Direction for ZoB defensible assessment to collect from improved parcels; but alert all unimproved parcels that upon improvement their parcels shall be subject to the assessment.

5.                     Direction to County Counsel to review complete Engineers Report for legal adequacy.
