Summary of Request:

AECOM has been providing Construction Management Services for the Measure B Psychiatric Health Facility project since working on the feasibility study that provided the basis for selecting the current project site. The original Construction Management agreement was based on an anticipated completion date at the end of 2025 and was extended through August 15th by amendment No. 1. Additional contract time through December 30, 2026 and third party commissioning were added to AECOM’s scope by amendment No. 2.

This proposed Third Amendment extends the current construction management service and staffing levels for the Psychiatric Health Facility (PHF) project through the expected date of completion, now at the end of October. This amendment also provides for the strong possibility that the County will rely on AECOM’s technical expertise and their previously prepared Time Impact Analysis (TIA) work to reach an agreement with the PHF Construction Contractor, Midstate Construction, over final responsibility for the cost impact of project delays. Project delays are approaching a full year, and both the County and Midstate bear some responsibility for the cost of those delays. Over the course of the project, AECOM has been deeply involved in reviewing and analyzing the project schedule and the causes for the delays to the project, including preparation of a comprehensive TIA under the terms of their current agreement. This amendment anticipates the likelihood of protracted and contentious negotiations, including advising the County on negotiating strategy, analysis of Midstate’s claims, proposals and TIA analysis, preparing for and participating in reconciliation meetings and related work associated with resolving Midstate’s delay claims through direct negotiations. This amendment does not anticipate the additional effort that would result if the matter escalates to mediation or legal proceedings triggered under the dispute resolution clause in the Midstate Contract.
