Previous Board/Board Committee Actions:
By Resolution Number (No.) 07-008 (January 9, 2007) the Board authorized the Director of Transportation to execute change orders pursuant to section 20395 of the California Public Contract Code, subject to certain cost limitations.
Summary of Request:
Public Contract Code section 20395 allows for the Board of Supervisors to authorize the Director of Transportation (County Road Commissioner) or a registered civil engineer under the direction of the Director of Transportation to execute contract change orders subject to certain cost limitations. Although Resolution 07-008 authorized the Director to execute change orders, the cost limitations were set to those in effect at that time. These cost limitations have been periodically updated since 2007 and will continue to be updated periodically in the future. We are requesting the Board authorize the Director of Transportation (County Road Commissioner) to sign contract change orders as designated in Public Contract Code Section 20395, including any future amendments, to allow for timely execution during construction. Change orders above the limits set forth in 20395 must be approved by the Board of Supervisors.
Alternative Action/Motion:
Do not authorize the Director of Transportation (County Road Commissioner) or a registered civil engineer under the direction of the Director of Transportation to execute contract change orders subject to the current and future cost limitations of California Public Contract Code section 20395.
