Adopt resolution authorizing the Director of Transportation to sign and submit an application on behalf of Mendocino County, to Bureau of Indian Affairs, for right-of-way over and across tribal lands for the purpose of ongoing groundwater monitoring at Laytonville Rancheria (Laytonville Area); and authorize Chair to sign same.

Previous Board/Board Committee Actions:

By Resolution Number (No.) 22-249 (December 13, 2022), the Board of Supervisors (BOS) approved Department of Transportation (DOT) Agreement No. 220034, Memorandum of Understanding Between the Cahto Tribe at the Laytonville Rancheria and County of Mendocino.                      

 

Summary of Request

On December 13, 2022, the County of Mendocino (County) entered into a Memorandum of Understanding (MOU) with the Cahto Tribe at the Laytonville Rancheria (Cahto Tribe) to establish a process and timelines for Cahto Tribe’s input and review of the project plans and cultural monitoring during the repair of the final cover of Laytonville Landfill.  Additionally, the MOU requires the County submit a right-of-way (ROW) application to the Bureau of Indian Affairs (BIA) to continue accessing two existing groundwater monitoring wells on Laytonville Rancheria.  The ROW application process requires a resolution of the governing body of an agency to identify the representative authorized to sign and submit such application.  DOT recommends and respectfully requests the Board adopt the attached resolution authorizing the Director of Transportation to sign and submit to BIA, on behalf of the County, an application for right-of-way over and across tribal lands for the purpose of ongoing groundwater monitoring at Laytonville Rancheria.

 

Alternative Action/Motion:

Do not authorize Director of Transportation to submit a ROW application and provide further direction to staff.
