Summary of Request:
The Lanterman-Petris-Short (LPS) Act is the California law governing the involuntary civil commitment of individuals who, due to mental illness, pose a danger to themselves, a danger to others, or who are gravely disabled and require inpatient psychiatric care. The intent of the LPS Act was to end inappropriate lifetime commitment of people with mental illness and firmly establish their right to due process while significantly reducing state institutional expense.
Pursuant to the requirements of the LPS Act, Mendocino County is responsible for providing residential care services to LPS clients who are court-mandated to receive a specific level of care requiring a structured environment due to mental health challenges. Currently, there are no local facilities in Mendocino County that are able to provide all levels of care as mandated by the courts. In addition, there is a shortage of residential care facilities statewide, which creates competition for these placements. As a result, Behavioral Health and Recovery Services (BHRS) contracts with multiple residential care facilities in order to help manage the shortage, and to maintain current client placements ensuring the most appropriate care within the largest possible placement options.
Mental Health Management Inc. DBA Canyon Manor (Canyon Manor) provides services classified as psychiatric/psychological rehabilitation through its mental health rehabilitation center located in Novato, California. Canyon Manor provides long term care for adults with serious mental illness by operating an Intensive Day Treatment program. Intensive Day Treatment is appropriate for seriously mentally ill clients who may have a concurrent medical problem(s) because of the severity of their mental illness. These clients require additional services, and at times, more intensive supervision and specialized treatment plans. Intensive Day treatment is an alternative to, and diversion from, State hospital placements.
On May 9, 2023, the County of Mendocino Board of Supervisors (BOS) approved Agreement No. BOS-23-066 with Canyon Manor for mental health treatment services to LPS conserved clients in Mendocino County, for Fiscal Year 2023-2024. On May 7, 2024, the BOS approved First Amendment No. BOS-23-066-A1 to increase the total amount to $213,000. Due to clients needing a continuously higher level of care, the previous estimated amount for services from Canyon Manor is not sufficient to cover costs. The proposed Second Amendment to Agreement No. BOS-23-066 increases the total amount by $70,000 for a new Agreement total of $283,000, for Canyon Manor to continue providing mental health services to LPS conserved clients in Mendocino County. Once the proposed Second Amendment is executed, it will be effective for the full term of the Agreement from July 1, 2023, to June 30, 2024.
