Previous Board/Board Committee Actions:

By Resolution Number (No.) 12-054 (March 27, 2012), the Board of Supervisors (BOS) approved BOS Agreement No. 12-034/Department of Transportation (DOT) Agreement No. 110118 with GHD, Inc., for completion of Plans, Specifications and Estimate (PS&E) package for the Mill Creek Bridge Replacement on Hill Road, County Road (CR) 327B, milepost (M.P.) 2.05. By Resolution No. 20-132 (October 6, 2020), BOS adopted an initial study/mitigated negative declaration and a mitigation monitoring and reporting program for this project in compliance with the California Environmental Quality Act (CEQA) requirements. By Resolution No. 23-104 (June 6, 2023), BOS approved BOS Agreement No. 23-096/DOT Agreement No. 220027 in the amount of $2,400.00, with and accepting the grant deed conveying real property from Robert L. Pintane and Diane L. Pintane, Trustees, for the acquisition of rights of way needed for the construction of the Mill Creek Bridge Replacement Project.

Summary of Request

Rights of way are needed for the above-referenced project for the removal and replacement of the existing bridge over Mill Creek and to realign the roadway approaches located on Hill Road, CR 327B, at M.P. 2.05. Previous Board action approved BOS Agreement No. 23-096/DOT Agreement No. 220027, accepting the Grant Deed for the conveyance of real property to the County from Robert L. Pintane and Diane L. Pintane, as Trustees of the Robert L. Pintane and Diane L. Pintane Revocable Trust dated August 9, 2002.  However, while in escrow, Robert L Pintane passed away necessitating an amendment to the original agreement. DOT is now requesting the Board approve Amendment No. 1 to Bos Agreement No. 23-096/DOT Agreement No. 220027 and accept the revised Grant Deed for the conveyance of real property to the County from Diane L. Pintane, as Successor Trustee of the Robert L. Pintane and Diane L. Pintane Revocable Trust dated August 9, 2002. The project is funded primarily through the Federal Highway Administration (FHWA) Highway Bridge Program (HBP) with the local match from toll credits.
