Summary of Request

County Counsel is requesting that the Mendocino County Board of Supervisors (“Board”) approve a legal services contract with attorney Terry N. Gross as a contract attorney for County Counsel to assist County Counsel with its representation of the Mendocino County Air Quality Management District (“MCAQMD”) regarding legal matters on which Ms. Gross has been lead counsel since May 2016.  County Counsel will be replacing Ms. Gross in stated legal matters as lead attorney for the District in these matters, but County Counsel desires that Ms. Gross remain as a contract attorney to assist with the litigation.  Ms. Gross had previously been employed as a Deputy County Counsel for Mendocino County and officially retired as of August 13, 2016.  Government Code section 7522.56(f)(1) allows the Board to rehire a retired employee prior to the 180 waiting period to fill a critically needed position.  The District previously waived this 180 period, but not Ms. Gross’ contract has expired.  Although County Counsel will replace Ms. Gross as lead attorney for MCAQMD, County Counsel request that the Board waive the 180 day waiting period pursuant to this section to allow Ms. Gross to work as a contract attorney with County Counsel without reinstatement or interruption of benefits.  There are no additional costs to the County associated with approval of County Counsel’s request.
