Previous Board/Board Committee Actions:
On August 1, 2017, the Board unanimously adopted a Resolution presenting to the voters of Mendocino County a Measure adopting the Ordinance adding Chapter 5.180 entitled the “Mental Health Treatment Act” to the Mendocino County Code adopting a County transactions (sales) and use tax for the specific purpose of funding improved programs, services and treatment for persons with mental health conditions, and ordering consolidation of said election with the consolidated general election called for November 7, 2017.
Summary of Request:
On November 7, 2017 the voters of Mendocino County voted 83.53% in favor of Measure B which adopted a sales and use tax for the specific purpose of funding improved programs, services and treatment for persons with mental health conditions. Measure B also mandated the creation of an eleven member “Mental Health Treatment Act Citizen’s Oversight Committee” (Measure B Oversight Committee) consisting of “a citizen selected by each member of the Mendocino County Board of Supervisors, a Member of the Behavioral Health Advisory Board, the County Mental Health Director or his/her representative, the County Auditor or his/her representative, the Mendocino County Chief Executive Officer or his/her representative; the Sheriff or his/her representative; and a representative of the National Alliance on Mental Illness.” Measure B encouraged the Board of Supervisors “to include professional experts such as psychiatric and health practitioners, first responders and other mental health professionals.” The Measure B Oversight Committee will act as an advisory board that will provide recommendations to the Board of Supervisors; review the required annual audit; and review the required performance management strategy to measure the effectiveness of the improved programs, services and treatment.
The Clerk of the Board is tasked with maintaining the roll of County committees and overseeing the appointment process. For continuity, it is recommended that the Clerk of the Board staff be charged with performing these tasks for the Measure B Committee. The Sheriff’s Office will be charged with providing administrative assistance to the Oversight Committee, including posting Agendas in accordance with the Brown Act, transcribing meeting minutes, and other related tasks in support of the committee.
Measure B explicitly named the County Mental Health Director, the County Auditor, the County CEO and the Sheriff, or their representatives, to the Measure B Committee. Therefore, it is recommended that the Clerk of the Board staff contact the above named officials to confirm whether they will personally serve on the Committee or, if not, the name of their representative.
Measure B empowers each member of the Board of Supervisors to “select” a citizen. By its terms, no other action is needed. However, for continuity of process it is recommended that the appointments be noticed for a specified period, that interested parties complete the standard application form, that each Supervisor be asked to identify their chosen representative and that those representatives be presented to the full Board for ratification. This is similar to the process by which each Supervisor names a district representative to the Planning Commission but they are formally appointed by the full Board.
Measure B states that the Committee shall contain a member of the Behavioral Health Advisory Board and a representative of the National Alliance on Mental Illness but no appointing authority is named.
The Board of Supervisors recommends that the Behavioral Health Advisory Board and the National Alliance on Mental Illness be requested to nominate individuals for these seats who would then be formally appointed by the Board in consideration with any otherwise qualified individual wishing to apply.
In summary, staff is making the following recommendations to the Board of Supervisors:
1.) Designate Clerk of the Board staff to maintain the roll and oversee the application and appointment process of the Measure B Oversight Committee;
2.) Direct Clerk of the Board staff to confirm with the Mental Health Director, Auditor, CEO and Sheriff if they will personally serve and if not, the name of their representative;
3.) Notice the appointment of the five citizens to be selected by the Board of Supervisors, the Behavioral Health Advisory Board member and the National Alliance on Mental Illness representative;
4.) Following the close of the application period, confirm with each Supervisor the name of their chosen representative;
5.) At the Board’s organizational meeting in January present the five supervisorial representatives and the nominees of the Behavioral Health Advisory Board and National Alliance on Mental Illness for formal appointment.
The Measure B Oversight Committee will hold its first meeting January 24, 2018 from 1:00-3:00 pm in conference room C.
