Approve the Mutual Aid Agreement between the County of Mendocino and the County of Humboldt for the mutual provision of temporary secure detention non-exclusive space for detained youth during an emergency evacuation for the period of Fiscal Year 2024-2025 through Fiscal Year 2026-2027, for an amount not to exceed $50,000 per fiscal year, and a maximum amount of $150,000 for the term of the Agreement; authorize the Chief Probation Officer to sign any future amendments that do not increase the total annual and/or total maximum Agreement amounts; and authorize Chair to sign same.

Previous Board/Board Committee Actions:

The County of Mendocino has previously contracted with the County of Humboldt’s Probation and Department of Health and Human Services-Mental Health departments to provide mental health treatment services as well as secure detention services to Mendocino County wards placed at the Northern California Regional Facility in the New Horizon’s Program on an as-needed basis.  The availability of these services was discontinued as of June 30, 2020.

 

On February 23, 2021, the County of Mendocino entered into a Mutual Aid Agreement with the County of Humboldt to provide temporary secure detention non-exclusive space for detained youth during an emergency evacuation for the period of February 23, 2021, through June 30, 2024.                     

 

Summary of Request

The County of Humboldt maintains a dedicated youth detention facility in its jurisdiction.  The County of Mendocino maintains a dedicated youth detention facility in its jurisdiction.  The County of Mendocino Probation Department desires to enter into an agreement with Humboldt County Probation to have the ability for either Department to provide non-exclusive temporary secure detention space for detained youth during an emergency evacuation.  Because each County maintains juvenile detention facilities in areas with a potential to sustain significant natural disasters, and because Humboldt and Mendocino Counties are close enough geographically to allow for accommodation on short notice, but far enough away to reduce the likelihood of both counties being impacted by the same disaster, Mendocino County is seeking to enact this agreement with Humboldt County.

 

This agreement allows for mutual aid to be provided at no cost for the first seven days of a disaster or other event that requires evacuation of the Juvenile Detention Facility.  This should provide sufficient time for both Departments to determine the like length of the event, as well as whether any disaster funding would be forthcoming to cover expenses.  In the unlikely event that disaster funding is not available after seven days of aid, this agreement details the fiscal responsibility to the participating agencies.

 

The execution of this agreement will provide a safe alternative for staff to rely on in the event of a natural disaster or other event that requires the Juvenile Detention Facility to be evacuated.

 

Humboldt County is the originator of this agreement.  Since our previous agreement for the period of February 23, 2021, through June 30, 2024, Humboldt County is required to receive California Department of Corrections and Rehabilitation (CDCR) approval on any new contracts.  The delay in receiving CDCR approval to proceed with this agreement resulted in the agreement being retroactive.
