Summary of Request:
This agenda item was prepared and submitted to the agenda software program with it intending to be included on the June 25, 2024, Board of Supervisors agenda. Unfortunately, a key date was not properly updated in the agenda software program, which resulted in it not being included on the official agenda for June 25, 2024. This item is now being submitted for retroactive approval to June 25, 2024, as part of an administrative correction.
On April 10, 2018, Resolution No. 18-053 was approved by the Board of Supervisors to maintain the salaries of the unrepresented County Counsel attorney classifications of Assistant County Counsel, Chief Deputy County Counsel, and Deputy County Counsel I-IV then and in the future, at a five percent (5%) differential above the salaries for attorney classifications represented by MCPAA. All other benefits for unrepresented County Counsel classifications remained tied to the Department Head Association through Resolution 10-006.
On May 7, 2024, Resolution No. 24-074 was approved by the Board of Supervisors, adopting the Unrepresented Employees Compensation and Benefits Resolution and establishing the terms and conditions of employment for unrepresented employees, elected department heads, and elected officials identified in Attachment A to that resolution.
The classifications of Assistant County Counsel, Chief Deputy County Counsel, and Deputy County Counsel I-IV are identified in Attachment A to Resolution No. 24-074.
Resolution No. 24-074 stated that “it is the intent of the Board of Supervisors that the terms and conditions of employment of all unrepresented employees, elected department heads, and elected officials, identified in Attachment A to this Resolution, shall be determined by the Board of Supervisors and shall not be linked to the terms and conditions of employment afforded to the Mendocino County Department Heads Unit or any other bargaining unit.”
Resolution No. 24-074 also rescinded Resolution No. 10-006, and all subsequent amendments thereto, which made applicable to certain unrepresented management employees the specific terms and conditions of employment afforded to the Mendocino County Department Heads Unit.
Consistent with Resolution No. 24-074, this action today is to remove the salary link of Assistant County Counsel, Chief Deputy County Counsel, and Deputy County Counsel I-IV to the attorney salaries of the Mendocino County Public Attorneys Association (MCPAA) bargaining unit. Instead, the terms and conditions of employment, including salaries, of these classifications will be established by the Board of Supervisors pursuant to the Unrepresented Employees Compensation and Benefits Resolution No. 24-074. This includes the salary adjustment for non-elected unrepresented employees in Resolution No. 24-074, previously approved by the Board.
In doing so, the Board will rescind all provisions of Resolution No. 18-053.
This action will not impact the current salaries for classifications of Assistant County Counsel, Chief Deputy County Counsel, and Deputy County Counsel I-IV, and the adjustments in those salaries as provided in Resolution No. 24-074.
