Recommended Action/Motion:

Approve Agreement with Hinderliter, de Llamas (HdL) and Associates in the amount of $100,000 for sales, use and transactions tax audit and related services; authorize the Chief Executive Officer or designee to sign any future amendments to the Agreement that do not increase the annual maximum amount; and authorize Chair to sign same.

Previous Board/Board Committee Actions:

On February 10, 2009, the Board of Supervisors adopted Resolution No. 09-027 certifying MuniServices, LLC, as the designated representative of the County of Mendocino to examine all sales and use tax records; and authorized the Chief Executive Officer to enter a No Cost Agreement with MuniServices, LLC. On November 17, 2015, the Board adopted Resolution No. 15-164 certifying HdL as a designated representative of the County of Mendocino to examine all sales and use tax records.  This was done to allow HdL to provide specialized services to the County related to sales tax auditing and analysis.

 

Summary of Request

The County conducted a Request for Proposals process and selected Hinderliter, de Llamas and Associates as the contracted sales, use and transactions tax audit and information services firm. The consultant will provide sales tax and economic analysis services, allocation audit and recovery services, consulting and other optional services. The sales, use and transactions tax audit services will be provided based on a 15% recovery fee.  The County’s previous agreement with MuniServices was based on a 25% recovery fee.  In addition to the recovery fee, the contract provides for up to $100,000 for additional services such as economic development efforts, transient occupancy tax auditing services, and other services that may be provided by HdL, if determined appropriate by the County.
