Previous Board/Board Committee Actions:
In 1991 the Board adopted Division II of Title 20 of the Mendocino County Code through Ordinance No. 3785. Chapter 20.532 is included in Division II, which establishes Coastal Development Permit regulations. Chapter 20.544 is also included in Division II, which establishes procedures for the appeal of Coastal Permit Administrator decisions.
Summary of Request:
The request is for a Coastal Development Permit (CDP) for Caltrans to implement the Gualala Downtown Streetscape Enhancement Project. The project site is located between State Route 1 post mile 0.6 and 1.0. The CDP was approved by the Coastal Permit Administrator on July 10, 2025.
On July 17, 2025, Stephen F. Johnson, on behalf of Bower Limited Partnership, filed an appeal of the Coastal Permit Administrator’s decision. The appellant asserts that the project must be denied because the findings cannot be met, specifically that the proposed development is not in conformity with the certified local coastal program and that the proposed development will not “further the intent” of the Gualala Village Mixed Use (GVMU) zoning district.
Pursuant to County Code Section 20.544.015, the Board of Supervisors may remand, affirm, reverse, or modify the decision and shall adopt findings which specify the facts relied upon in deciding the appeal.

Alternative Action/Motion:
Multiple options are provided in the staff memorandum, including (1) modifying the Coastal Permit Administrator’s approval to add a condition of approval including landscaping, (2) remanding the decision to the Coastal Permit Administrator to reconsider the project, (3) reverse the Coastal Permit Administrator’s decision, or (4) modify the Coastal Permit Administrator’s decision in alternate ways than reviewed by staff. The Board must adopt findings which specify the facts relied upon in deciding the appeal.
