By Resolution Number (No.) 22-249 (December 13, 2022), the Board of Supervisors (BOS) approved Department of Transportation (DOT) Agreement No. 220034, Memorandum of Understanding Between the Cahto Tribe at the Laytonville Rancheria and County of Mendocino.
Summary of Request:
Laytonville Landfill has been closed and in post-closure maintenance status since 1997. Following the placement of the final cover, it was determined the slope construction had deficiencies, which led to intermittent erosion issues. In 2006, Department of Transportation (DOT) proposed to perform a final cover repair project to remediate the slope deficiencies and developed plans for the repairs; however, the project was never completed and the erosion has been addressed through ongoing maintenance since that time. In 2021, to reduce maintenance issues, DOT issued a request for proposals (RFP) for a consultant to update the remediation plans. After receiving two proposals in response to the RFP, the North Coast Regional Water Quality Control Board (NCRWQCB) brought to the attention of DOT that the Cahto Tribe at the Laytonville Rancheria (Cahto Tribe) had initiated a government-to-government consultation with the CalEPA and, through that process, had expressed a desire to have input on the final cover repair project. NCRWQCB requested DOT place the project on a temporary hold to allow time to come to an agreement with Cahto Tribe regarding their involvement in the project. An MOU was finalized in December 2022 between the Cahto Tribe and County of Mendocino, establishing a process and timelines for Cahto Tribe’s input and review of the project plans and cultural monitoring during certain construction activities. Following approval of the MOU, DOT reissued the RFP for engineering and design services, this time including provisions for community meetings and tribal consultation. Only one proposal was received from Geo-Logic Associates, Inc. (GLA); however, GLA is teaming with SWT Engineering and Rincon Consultants, all professional consulting firms with extensive relevant experience. DOT recommends and respectfully requests the Board adopt the resolution approving DOT Agreement No. 220042, with Geo-Logic Associates, Inc., for engineering and design services for Laytonville Landfill cover repairs.
