Summary of Request

On March 25, 2025, Mendocino County's Public Health (PH) Women, Infants, and Children (WIC) program submitted the fifth amendment to Agreement 22-10260 with the California Department of Public Health (CDPH) in the amount of $3,518,452.00 for approval. The Mendocino County Board of Supervisors (BOS) executed this agreement as No. BOS 22-236-A4 to continue supporting essential WIC program services throughout Mendocino County. After execution, the agreement was sent to the CDPH Women, Infants, and Children Program Division for final signatures.

 

The CDPH returned a revised, executed version that included additional changes not present in the original version approved by the BOS, which are outlined below:

 

V. Exhibit C, GTC 04/2017 has been replaced with Exhibit C, GTC 02/2025. This new exhibit is hereby incorporated by reference and made part of this agreement as if it were attached. It can be viewed at https://www.dgs.ca.gov/OLS/Resources.

 

VI. Exhibit D, Special Terms and Conditions has been entirely replaced.

 

As a result of these revisions, PH resubmitted the updated agreement to the BOS on July 29, 2025, for approval. The BOS approved Agreement No. BOS No. 22-236 A5; however, the CDPH subsequently rejected it, stating that BOS 22-236 A4 is the final agreement with them.

 

Public Health WIC is now requesting that the BOS approve and acknowledge the revisions to Agreement No. BOS No. 22-236-A4 (as revised by CDPH), accepting the additions in sections V and VI, which have been reviewed and approved by County Counsel and Risk.
