Previous Board/Board Committee Actions:

On September 22, 2020, the Board of Supervisors directed Planning and Building Services to engage in an interagency agreement with the California Department of Fish and Wildlife (CDFW) for a biologist to assist with Sensitive Species Habitat Review.

Summary of Request

On September 22, 2020, the Board of Supervisors directed Planning and Building Services to engage in an interagency agreement with the California Department of Fish and Wildlife (CDFW) to assist staff with Sensitive Species Habitat Reviews conducted pursuant the Chapter 10A.17.

Cannabis Department staff conducts initial Sensitive Species Habitat Reviews for each commercial cannabis cultivation and nursery application reviewed by the department.  If staff determines that the applicant is not meeting one or more of the performance standards identified in the screening tool or determines that the applicant’s ability to meet one or more of the performance standards is unknown, staff must refer the application to CDFW for further review.

The proposed retroactive agreement would reimburse CDFW for referrals conducted dating back to February 2, 2021, and allow the department to pay for CDFW referrals through November 2, 2022, at which time the agreement will need to be reinstated.  Funding for the retroactive agreement is included in the Local Jurisdiction Assistance Grant Program (LJAGP) budget and will not impact general funds.
