Rejection of all bids submitted for bid number 017-25 for the Bower Park Restoration and Improvement Project and direction to staff to rebid the project with reduced scope on July 8, 2025

 

Declaration of Bid No. 025-25 for the rebid of the Bower Park Restoration and Improvement Project as a failed bid due to no bids being received and authorization for the award of the Project, pursuant to Public Contract Code section 22038, to Miguel Angel Rodriguez Zepeda, doing business as MARZ Engineering, and approval of an Agreement with MARZ in the amount of $1,074,275 for Phase 1 and a not-to-exceed amount of $325,000 for Phase 2 of the Project.                      

 

Summary of Request

Pursuant to the above noted agreement with Marz Engineering, the County has negotiated the scope of work adjustment for the Phase 2 work that can be completed responsibly within the existing grant funding by deferring fencing and landscaping and other work. Staff have also received the required payment and performance bonds for Phase 2, and issued the Phase 2 notice to proceed.

 

At the time of award the combined Phase 1 and Phase 2 contract value, capped by the available funding was not sufficient for the scope included in the original bidding documents, and the agreement included provisions to value engineer or defer contract scope to align with the contract amount and available contingencies.

 

However, due to several issues including the extensive staff effort required to issue two separate bids, the involved negotiations resulting in the current contract after no bids were received from the second bid and satisfying several unanticipated conditions of approval for the project’s use permit, the remaining available funding has been further constrained. As a result the final construction contract does not include several important features originally included in the bid documents, specifically, all new landscaping and irrigation, new and repaired fencing and the supply and installation of new picnic tables, benches and trash receptacles.

 

This funding request will provide for preserving these elements of the original bid scope into the finished project. This request for one time funding of $170,000 includes approximately $31,000 for the purchase of new tables, benches, and other amenities, and approximately 123,000 in contract change orders to support the inclusion of the landscaping, irrigation, fencing, and installation of the new amenities. The remaining $16,000 will restore contingencies for unforeseen conditions, staff time and other project expenses.

 

This item authorizes the Purchasing Agent to negotiate and execute two or more change orders with the Contractor and additional purchase orders for park amenities as required by this approval.

 

Alternative Actions/Motions:

Do not approve the additional funding, resulting in a completed project that defers all landscaping and irrigation and limits fencing work to only that required for the baseball field and tennis court, and includes no new amenities.

 

Approve partial funding in any of the following increments including direction to staff to appropriate the necessary one time funding and authorize change orders for:

 

50% funding of $85,000 to include the additional staff labor costs, new site amenities, fencing and installation of site amenities only; deferring the landscaping and irrigation; or,

 

Minimum funding of $36,000 offsetting the staff labor costs that will allow the inclusion of the important fencing and gate repairs; deferring new site amenities, landscaping and irrigation.
