Previous Board/Board Committee Actions:
On September 10, 2024, the Mendocino County Board of Supervisors adopted Ordinance No. 4538 amending Division I of Title 20 of Mendocino County Code, including amendments to Chapter 20.236 which regulates Towers and Antennas.
Summary of Request:
On June 19, 2025, the Mendocino County Planning Commission approved Use Permit U_2024-0004 for the construction of a new cell tower at 28401 Timberline Road, Willits. The Planning Commission adopted Resolution Number PC_2025-0007 which approved the 65 foot tall cell tower subject to certain Conditions of Approval as contained in Exhibit A to the Resolution. During the public hearing on June 19, 2025, the Planning Commission added Condition of Approval #29 that requires “Prior to issuance of the building permit, existing code violations on the property will be remediated.”
On June 30, 2025, the Applicant filed an appeal of the Planning Commission’s approval specifically to address Condition of Approval #29. The appeal states, in part, that “…the condition is overly broad as there is no essential nexus or rough proportionality between the project that was approved and the condition being attached, and as such, it is requested that the Condition be removed.”
