Summary of Request

The City of Fort Bragg is preparing for construction on the Bainbridge Park Enhancement Project, to revitalize and improve one of the City’s most heavily used parks.  The County-owned Fort Bragg Veterans Memorial Building is adjacent to the park and not separated from the park by any fencing.  As a component of the comprehensive park enhancements, the City is willing and desiring to improve and maintain portions of the County property.  These improvements will include demolition and reconstruction of deteriorated concrete pathways, installing and maintaining new landscaping, and a stage pavilion.  The work area will be maintained in a neat and workmanlike condition, with affected areas restored to a clean and safe state. The proposed license agreement contains an indemnification clause for all claims arising out of the City’s project and the use of the area as part of Bainbridge Park.  Maps of the license area and the project are attached to the license agreement.

 

In order to approve the license agreement, Government Code Section 25526.6 requires that the Board make two findings: that the conveyance is in the public interest and that the interest in the land conveyed will not substantially conflict or interfere with the use of the property by County.  Staff believe that including the outdoor areas of the Veterans Memorial Building as part of the broader Bainbridge Park Enhancement Project will create an improved asset for public enjoyment and recreation.  Secondly, the license will not substantially conflict or interfere with the use of the County’s property.  The Veterans Memorial Building will remain usable during and after construction, and the outdoor portion of the property will have improved landscaping following construction.
