Approve retroactive first Amendment to Agreement No. BOS-19-271 with Nacht and Lewis for predesign, design, and construction support services for Crisis Residential Treatment, Crisis Stabilization Unit, and Psychiatric Health Facility(ies) in the amount of $0 for a total of $3,357,568, effective December 18, 2019 through a new end date of June 30, 2026 (original end date of June 30, 2022); authorize the Purchasing Agent to act as Project Manager and approve Change Orders for the project, pursuant to Public Contract Code Section 20142; authorize the Behavioral Health Director or designee to sign any future amendments that do not increase the annual maximum amount; and authorize Chair to sign same.

Previous Board/Board Committee Actions:
February 5, 2019, the Board directed staff to research options associated with Crisis Residential Treatment (CRT), Psychiatric Health Facility (PHF), and Crisis Stabilization Unit (CSU) facilities, including design/bid/build and potential property and facility locations. The Board receives updates from the Mental Health Treatment Act Oversight Committee regularly.
November 19, 2019, Item 5(d), the Board conditionally approved Agreement No. BOS-19-271 with Nacht and Lewis, for predesign, design, and construction support services for Crisis Residential Treatment, Crisis Stabilization Unit, and Psychiatric Health Facilities, pending Measure B Committee approval.
December 18, 2019, the Measure B Committee approved Agreement No. BOS-19-271.
Summary of Request:
Per direction from the Board of Supervisors (BOS), the Executive Office solicited a Request for Qualifications/Proposals (RFQ/RFP) on June 19, 2019, from qualified architects for facilities design work, including architectural, engineering, and environmental (CEQA), and a feasibility study/analysis for two sites located in Mendocino County, for the services of Psychiatric Health Facility, Crisis Stabilization Unit, and Crisis Residential Treatment.
Nacht and Lewis was chosen by the RFQ/RFP evaluation panel committee, and with BOS authorization, on December 18, 2019, the Mendocino County Executive Office entered into Agreement No. BOS-19-271 with Nacht and Lewis. Under Agreement No. BOS-19-271, Nacht and Lewis has been providing for the predesign, design, and construction support services for Crisis Residential Treatment, Crisis Stabilization Unit, and Psychiatric Health Facility(ies).
On September 20, 2022, Behavioral Health and Recovery Services (BHRS) was notified that Agreement No. BOS-19-271 had expired on June 30, 2022, and that in order for services to continue, BHRS should prepare a retroactive Amendment, transferring the Agreement from the Executive Office to BHRS, and extending the term through June 30, 2026, necessitating retroactive approval.
