Previous Board/Board Committee Actions:

By Resolution No. 16-099 (August 2, 2016) the Board of Supervisors (BOS) authorized DOT to advertise for bids and award DOT Contract No. 160047 to perform repairs to a portion of the westerly capping fill of the closed Laytonville landfill, and increase the Director of Transportation’s change order authority to 10% of the contract.                     

 

Summary of Request

On September 7, 2016, DOT Contract No. 160047 was awarded to Bouthillier’s Construction, Inc., of Willits, California, in the amount of $251,480.  A 10% contingency was authorized for this project.  Construction on this project has been completed. The total amount of contract change orders exceed the current change order limit of $25,148 by $25,593, so DOT requests the BOS increase the limit by $25,593 to $50,741.  These overages are due to adjustments in the estimated quantities of line items, which were not known at the time of construction and were necessary to complete the work without causing project delays.  Bouthillier Construction, Inc., has agreed to accept a lower unit price for the items exceeding 125 percent of the originally estimated quantities.  Funds are available in the Landfill Closure Fund to cover this increase, which has not yet been paid to the contractor.  Additionally, DOT would like to file the Notice of Completion to commence the applicable lien periods, and pending no claims, release Contract Sureties after expiration of lien periods.  Contract Surety must be released as prescribed by existing laws.

 

Alternative Action/Motion:

Do not approve the requested increase in change order authority and postpone approval of the Notice of Completion and release of Contract Sureties for DOT Contract No. 160047.
