Previous Board/Board Committee Actions:
On March 7, 2017, the Board Adopted an Ordinance amending Chapter 9.05 of the Mendocino County Code which allowed the Local Emergency Medical Services Agency, as directed by the Board, to establish one or more EOA’s.
Summary of Request:
The County of Mendocino is requested to consider entering into a Memorandum of Understanding ("MOU") with the City of Ukiah regarding the request for proposal process to establish an exclusive operating area ("EOA") for emergency ambulance services for inland Mendocino County. The City of Ukiah is considering this MOU at their May 16th City Council Meeting. City and County staff were able to meet and develop a final draft of the MOU that is being offered to the board/council for consideration with a staff recommendation to approve.
During the County's development of the request for proposals for an exclusive emergency response ambulance service, the County has taken the position that the City cannot participate in the detailed drafting of the RFP because of the potential contractual relationships that may arise between the City and potential Bidders related to support and back-up services. In order to ensure any concerns are discussed and addressed prior to the award of an RFP, County staff has offered a Memorandum of Understanding with the City to ensure that issues could be addressed once the RFP is released and available for review. The MOU gives the City 14 days to submit comments and concerns. If comments are submitted, the City and County will be required to meet and confer in good faith to address the City’s concerns.
Also included in the MOU are provisions that acknowledge that the City will not be a bidder on the RFP, but acknowledges that the City will not waive any rights it may have concerning the administration of emergency medical services or its respective authority under the EMS Act.
