Summary of Request

Caltrans’ construction project in Hopland will temporarily displace public parking along the Highway 101 corridor.  While the entity creating local impacts (Caltrans in this case) is typically the entity that should  mitigate those impacts, the County has an unusual and no cost opportunity to engage in this instance and help support the impacted community.  The Great Redwood Trail Agency (GRTA) owns land along the railroad tracks and GRTA is willing to license that property to the County for use as temporary replacement public parking, with fees waived due to the public benefit provided by this arrangement.  The agreement includes provisions requiring the County to provide insurance coverage and indemnify GRTA related to use of the property  Additionally, the County will become responsible for ensuring trash that may accumulate is picked up, and the County may need to establish parking rules for this area in the future.  It is requested the Board ratify the application submitted to the GRTA, and authorize the CEO to sign a license agreement from GRTA, at no cost to the County, effective July 1 2026 through December 31 2026, with authorization for extension(s) up to six additional months if necessary.

 

Government Code Section 54031 provides that a local agency may, by purchase or other manner, acquire property for parking motor vehicles.  Separately, Government Code Section 54033 provides that the local agency may permit use of the property by the public for parking motor vehicles when in the judgement of the legislative body such use is necessary and convenient.  In this instance, the licensing of the subject property for temporary public parking is necessary and convenient in order to offset the temporary loss of public parking along Highway 101 and lessen impacts to Hopland residents and businesses.
