On July 18, 1956, Ordinance No. 363 was adopted, with multiple amendments since, the last being Ordinance No. 4342, adopted on August 18, 2015.
                     

Summary of Request

Section 3.04.120 - Additional Compensation, of the Mendocino County Code, currently reads as follows:

 

Appointment as Acting Department Head. When a vacancy as department head exists due to death, resignation, retirement or incapacity, and the Board of Supervisors makes an appointment of an acting department head, the person so appointed shall receive a one (1) step increase or equivalent thereto in his existing salary. If it is known that such an appointment as acting department head will be of six (6) months, or longer duration, then the appointee shall receive an additional one (1) step increase or equivalent thereto in his existing salary. This increase shall continue during the term of his appointment as acting department head. During this appointment if the appointee is eligible for a merit salary increase as provided in Section 3.04.080 of this Title, he may receive such salary increase and additionally shall receive the aforementioned increase or equivalent thereto.

 

The proposed amendment clarifies and modernizes the provision as follows:

 

                     1.                     Renames the Section as “Appointment of Interim Department Head.”

 

                     2.                     Clarifies that either the Board of Supervisors or Chief Executive Officer, as the appropriate appointing authority for a particular department head position, may appoint an interim department head due to a vacancy in that position.

 

                     3.                     Establishes a ten percent (10%) pay increase from the employee’s current appointed job classification for the duration of their interim appointment as a department head. 

 

                     4.                     Defines how merit and salary schedule increases are applied during the interim appointment as a department head.

 

                     5.                     Clarifies that the pay shall not exceed the established salary of the interim appointment department head position.

 

                     6.                     Confirms that an employee working in an interim appointment shall not be entitled to receive any other compensation and benefits that may be associated with the interim appointment department head position.

 

                     7.                     Confirms that the section does not apply to appointments to fill vacancies in elected official positions pursuant to Government Code § 25304.
