SUMMARY OF REQUEST:
Welfare and Institution Code Section 5351 specifies that the governing Board shall designate the agency responsible for providing conservatorship investigation under the Lanterman-Petris-Short (LPS) Act. This Resolution establishes Behavioral Health and Recovery Services of Mendocino County as the Public Conservator and agency designated to provide conservatorship investigation under the LPS Act. The Public Conservator investigates referrals for LPS conservatorships to arrange placement and mental health treatment for adults who are gravely disabled as the result of a mental disorder, are incapable of accepting voluntary treatment, and do not have family or others able and willing to help meet personal needs. LPS Investigators assess and make recommendations to the Court regarding the appropriateness of a Temporary and/or Permanent LPS conservatorship. Conservatorship Investigators also perform investigations and make recommendations to the Superior Court on a variety of issues that relate to conservatees.
