Approve second amendment to BOS Agreement 20-143 with Inmate Calling Solutions, LLC, to eliminate service fees of inmate telephone services per the Federal Communications Commission (FCC) Report and order FCC 24-75, WC Docket Nos. 12-375 and 23-62, designate a non-commissionable portion of each call; and authorize Chair to sign same.

PREVIOUS BOARD/BOARD COMMITTEE ACTIONS:
On October 20, 2020, the Board approved a five-year Agreement with Inmate Calling Solutions, LLC, for inmate communication services. On June 13, 2022, the Board approved the First Amendment that reduced rates and billing fees as ordered by the California Public Utilities Commission.
SUMMARY OF REQUEST:
Inmate Calling Solutions, LLC, provides telephone and tablet services for use by incarcerated individuals in the Mendocino County Jail. On July 22, 2024, the FCC released an order that eliminated service fees for processing credit and debit card purchases for calls and limited commissions. Commissions will continue to be calculated at the state contract rate of 55% of the gross call revenue for all call types, however, the first $0.10 of each call will be designated as non-commissionable to offset the elimination of service fees. These changes took effect on November 19, 2024, the "Change in Law Date".
