Summary of Request:
Under the Government Claims Act (Government Code Section 900 et seq.), a claim relating to a cause of action for injury to a person or to personal property must be presented to the County no later than six months after the accrual of the cause of action.

Pursuant to California Government Code § 911.4, an application to present a late claim must be presented within one year of the accrual of the cause of action. Moreover, a claimant applying to present a late claim must establish that the failure to timely present the claim was attributable to one of the factors listed in Government Code § 911.6.

On August 14, 2026, Claimant submitted an application to present a late claim against the County. The application identified a date of September 17, 2025, as the date associated with the claim. However, the application fails to show that the failure to submit a timely claim in this case was attributable to any of the listed factors.

County Counsel recommends denial of the request.
