SUMMARY OF REQUEST:
Under the Government Claims Act (Government Code Section 900 et seq.), a claim relating to a cause of
action for injury to a person or to personal property must be presented to the County no later than six months after the accrual of the cause of action. On February 18, 2025, Claimant in this matter presented a claim regarding an incident that Claimant identified as occurring on October 15, 2023. The claim was returned as untimely. On May 1, 2025, Claimant submitted the same claim, with an additional "Date of Incident" identified as January 5, 2024, along with a letter applying to the Board for leave to present a late claim.
Pursuant to California Government Code ? 911.4, an application to present a late claim must be presented within one year after the accrual of the cause of action. Claimant identifies the accrual of her cause of action as either October 15, 2023, or January 5, 2024, both of which are more than one year prior to the date on which Claimant presented the claim to the County, February 18, 2025.
County Counsel recommends rejection of the request.
