PREVIOUS BOARD/BOARD COMMITTEE ACTIONS:
On December 13, 2022, the Board received a presentation by Civitas Advisors regarding the benefits of converting the Business Improvement District to the 1994 District Law. On June 6, 2023, the Board discussed the conversion of the Business Improvement District during the County budget hearing. On September 12, 2023, the Board approved the annual service agreement with Mendocino County Tourism Commission related to the Business Improvement District transition. On September 26, the Board approved a resolution approving an agreement with Civitas Advisors to assist the County in transitioning from the current BID to one formed under the 1994 Law and authorized Civitas to review certain tax records.
SUMMARY OF REQUEST:
Resolution 23-160, approved on September 26, 2023, authorized Civitas to review sales and use tax records, but listed the State Board of Equalization. The correct department is the California Department of Tax and Fee Administration, which took over administration of sales and use taxes in the last several years. The Department has required an updated resolution be adopted. The attached resolution has the corrected information for the State and reflects that the prior resolution approved the contract with Civitas.
