Previous Board/Board Committee Actions:

The reconstruction and widening of East Side Potter Valley Road, CR 240, from M.P. 2.46 to M.P. 6.42 (Project) has been a proposed project of the Department of Transportation (DOT) for over a decade.  By Minute Order at the September 12, 2000, meeting of the Board of Supervisors (BOS) the BOS authorized DOT to apply for State Transportation Improvement Programmed (STIP) funding, which was allocated on July 1, 2010.  The BOS approved a Mitigated Negative Declaration pursuant to California Environmental Quality Act (CEQA) requirements for the Project on June 4, 2008.  Since July 2014 the BOS has approved 18 resolutions, approving a total of 76 agreements acquiring property needed for the construction of the Project.  Under these resolutions, the BOS accepted the grant deeds from the various landowners of the above-mentioned agreements to acquire the necessary property for the Project.  On February 3, 2015, the BOS adopted Resolution Number (No.) 15-022, a Resolution of Necessity authorizing acquisition and condemnation of certain portions of real property, which included the properties proposed to be acquired by this action. All of these acquisitions settled out except for one that was settled by the courts on December 24, 2015.                     

 

Summary of Request

The East Side Potter Valley Road Reconstruction and Widening project is programmed for construction Phase II in Fiscal Year 2020-21.  The Project now requires approximately $7 million of additional funding to pay for the increased construction costs and DOT therefore is seeking additional funding sources.  DOT is requesting BOS to support its application requesting $7 million in California Federal Lands Access Program (CFLAP) funding to leverage the $3.5 million STIP funds currently allocated for construction and the $5.1 million STIP and local funding already spent on Phase I that included Design, CEQA, Right of Way, and Utility Relocation phases.  If granted, the County will be required to make a 10% matching contribution in order to receive the CFLAP award.  On 23 January 2017, the Federal Highway Administration (FHWA) issued a Call for Projects under the CFLAP.  Deadline for receipt of project applications at FHWA is on 12 May 2017.  The CFLAP project applications are expected to be reviewed and ranked by California’s Programming Decisions Committee (PDC). Based on their evaluations a short list will be released July 2017 with the final PDC project selection meeting in August.  The programs selected to be funded announcement is scheduled for September 2017.

 

Alternative Action/Motion:

Do not adopt resolution supporting DOT’s CFLAP application and do not authorize DOT to process CFLAP application.
