On March 7, 2017, the Board of Supervisors referred this matter to Committee for review.
SUMMARY OF REFERRAL:
On June 12, 2017, after referral from the Board of Supervisors, this matter was presented before the Committee for discussion and possible direction to staff. Following discussion and public comment, direction was given to Mendocino County Department of Transportation (MCDoT) to return to the Committee with a draft ordinance to amend Mendocino County Code Section 15.20 "Encroachment Upon County Highways" and a draft amendment to Mendocino County Policy Number (No.) 14 "Street Closure". Staff has prepared drafts for the Committee's consideration and recommendation to the Board of Supervisors. As directed by the Committee, and supported by Risk Management and County Counsel, both the proposed policy and County Code amendments include language requiring encroachment permit applicants to submit proof of general liability insurance in the amount of $1,000,000, with some discretion given to MCDoT to increase or decrease this limit. Additionally, the current encroachment permit indemnification language has been provided to County Counsel to undergo review and possible update. MCDoT recommends renaming Policy No. 14 "Street Closure" to "Encroachment Permits", and rewriting it, including policy on street closure. ...
