Recommended Action/Motion:
recommendation
Approve rescission of County Policy Number (No.) 14 “Street Closure” and replacement with County Policy No. 14 “Encroachment Permits” (Countywide).
End
Previous Board/Board Committee Actions:
On November 25, 1986, the Board of Supervisors, by Minute Order, adopted Mendocino County Policy No. 14 “Street Closure”. By Resolution 98-006 (January 6, 1998), the Board rescinded the previous policy and adopted a new Policy No. 14. By Resolution 01-268 (December 4, 2001), the Board rescinded the previous policy and adopted a new Policy No. 14.
Summary of Request:
After referral from the Board of Supervisors, the issue of requiring insurance for encroachment permits was presented before the Public Health, Safety and Resources Committee on May 8, 2017, and again on July 10, 2017. During those meetings, it was determined an update to County Policy No. 14 would also be appropriate to incorporate the insurance requirement as well as several other issues that arose from the discussions. On August 15, 2017, the Board introduced and waived reading of an Ordinance amending Section 15.20.030 of the Mendocino County Code - Permit Required for Certain Construction, adding Section 15.20.030(E) to require insurance for encroachments permits. That Ordinance is on the September 12, 2017, agenda for possible adoption by the Board. MCDoT has prepared a draft corresponding rewrite of County Policy Number 14 for the Board’s review. Appropriately, the draft policy has been renamed from “Street Closure” to “Encroachment Permits” as it now contains policy on all types of encroachment permits rather than only street closures. If the Board votes to adopt the Ordinance, MCDoT also requests the Board consider adopting the corresponding policy update.
Alternative Action/Motion:
Do not approve rescission of Policy No. 14 and provide further direction to staff.
