January 22, 2019: Formation of an Ad Hoc Committee to discuss issues related to Cannabis cultivation Ordinance.                     

 

Summary of Request

The Cannabis Cultivation Ad Hoc Committee held public meetings in Covelo, Willits and Fort Bragg; met with stakeholders and met with staff involved with cannabis regulation. Specific recommendations of the Ad Hoc Committee are contained in the attached memorandum and fall into several categories.

 

The Board previously gave direction on a number of items that were not included in the most recent ordinance amendment because they required further study. The Ad Hoc Committee agrees with staff recommendations on the need for and timing of these items. The Board is also requested to confirm previous direction that Phase 3 permits be subject to Use Permits and that staff present specific recommendations on implementation. The Ad Hoc Committee also agrees with staff recommendations for minor ordinance amendments to conform to State law, improve internal consistency or simplify administration of the ordinance.

 

The Ad Hoc Committee is making several significant recommendations, including delaying the start of Phase 3 until June 30, 2020; allowing for “transferability” for all Phase 1 permitted cultivation sites, including those in RL, FL and TPZ; and a limited extension of the sunset period for permitted indoor cultivation sites in proximity to the Coastal Zone. The Ad Hoc Committee believes the lack of a Coastal Zone cannabis ordinance and the limited availability of suitably zoned parcels limited relocation opportunities and an extension of the sunset period for cultivators in proximity to the Coastal Zone is therefore reasonable. The Ad Hoc Committee also recommends discussion of the issues of allowing new permits in Rangeland permit size, clarification of the number of permits allowed per entity and Live Scan requirements.
