Summary of Request:
The addition of section 2.38.020 will allow the Sheriff, or his or her designated representative to determine which Reserve Deputy Sheriffs are appointed as “designated” Reserve Deputies [Penal Code Section 830.6(a)(2)] or “non-designated” Reserve Deputies [Penal Code Section 830.6(a)(1)]. Current reserve deputies’ peace officer powers are limited to the duration of their assignment. According to the provisions of Section 830.6(2) of the California Penal Code, whenever any qualified person is deputized or appointed as a reserve peace officer, and is so “designated” by a local ordinance or resolution, that person designated will have the full powers and duties of a full-time peace officer. The addition of section 2.3.020 will allow the Sheriff to appoint qualified individuals as such reserve deputies, who would have full peace officer powers. “Designated” Reserve Deputy Sheriffs will also augment the Sheriff Office’s limited field staff - especially during emergencies, natural disasters and other significant events which stretch available resources to their limits. The proposed ordinance has been reviewed by Risk Management and Human Resources. The County has met its obligations with regard to “meet and confer” with the respective bargaining unit.
